Ben Posford, head of catastrophic injury at Osbornes LLP, a Brain Injury Group member, shared his thoughts in today’s Times about impending changes to the Enterprise and Regulatory Reform Act, due to come in force next month. Posford warned that while the law will put the onus on the individual to prove an employer’s wrong-doing, it is still a criminal offence to be found in breach of health and safety regulations that could result in a compensation claim.
Posford also hopes that that an increase in employer complacency will not lead to a reversal in the downward trend in workplace deaths in recent years, and envisages that we may see high-profile custodial sentences for gross negligence to redress the balance.
