Ashton KCJ, an East Anglia based law-firm and member of the Brain Injury Group, has obtained a substantial settlement on behalf of a 10 year old girl who suffered brain damage at birth after being deprived of oxygen.
Emily Dye, from Easton, near Norwich, has severe cerebral palsy and needs full-time care. Her family pursed a legal case against Norfolk and Norwich University Hospital for the errors that occured during Emily’s birth, and has been awarded a settlement which is likely to amount to in excess of £4 million over her lifetime.
Tom Cook a medical negligence specialist of legal firm Ashton KCJ, who represented Emily’s family, said that the majority of the monies awarded would be to compensate for the fact that Emily would be unable to earn her own living, requiring the care of others for the rest of her life.
The judge, Mr Justice Stuart-Smith, praised the devoted care shown by Emily’s parents, and said he hoped the settlement, awarded against the hospital trust, would make life easier for all of them.
