“I’ll never give up on my brain injured husband” says Nicola Hiscocks whose husband, Ashley, suffered serious head and orthopaedic injuries in a motorcycle crash with an uninsured van driver eight years ago. Ashley suffered multiple injuries including fractures in his neck and spine, fractured sternum and multiple rib fractures, resulting in flail chest, both lungs punctured, a severely bitten tongue and serious head injuries.  He has been left with partial physical disability and brain damage that has completely changed his personality and temperament. He cannot be left unattended, he has fits of temper, chronic fatigue and sleeps less than two hours a night.

Ashley has been married to Nicola since 2000 and they have known each other for 25 years . They have two children Daniel, 24 and Alex, 19.  Nicola, shares how Ashley’s accident has changed their lives in Fabulous magazine, June 23rd.

Nicola and Ashley sought legal help from brain injury specialist firm Hugh James, who are now a member of the Brain Injury Group. Nicola has also spoken of her overwhelming relief when she met Andrew Harding and Cari Sowden-Taylor, solicitors at Hugh James, who were approachable, friendly and completely understanding of the many challenges Nicola and Ashley were facing. Nicola can’t bear to think how differently things might have turned out if she hadn’t found them and says that Cari should have a halo for all her kindness, compassion and supreme professionalism in managing their case.

Hugh James worked tirelessly with a number of medical and other experts to show the impact of Ashley’s injuries on his life. They saw a reconstruction of the accident to prove Ashley was neither at fault nor speeding at the time of the collision. They rejected lower settlement offers, convinced they had a strong case. They secured interim payments while the case progressed and that helped to fund a case manager and put in place a care programme for Ashley. Eventually, they settled a compensation that will help to secure Ashley’s future but, as Nicola points out, no amount of money can possibly bring back all that Ashley and the family have lost.
