However, where a person lacks mental capacity to make decisions—particularly in brain injury cases—there is no time limit for bringing a claim on their behalf.

Dean Wilson Case Study – Complex Brain Injury & Psychiatric Overlap

This case study demonstrates how a seemingly straightforward road traffic accident can evolve into a complex legal matter involving both neurological injury and psychiatric complications. In such cases, identifying the right legal approach early helps secure appropriate rehabilitation, obtain key medical evidence, and properly assess the long-term impact of the injuries.
 
The Claimant, riding a Vespa, was forced to take evasive action when the Defendant pulled out from a side road without noticing them. They sustained a significant head laceration and jaw injury and were initially discharged from hospital. Around five weeks later, however, they experienced a severe psychotic episode, resulting in readmission under section.
 
Further medical investigations revealed micro-haemorrhages consistent with a traumatic brain injury caused by the accident. While the physical effects improved over time, there was significant dispute regarding the ongoing psychiatric condition—specifically whether it was post-traumatic psychosis or bipolar disorder, and if it was bipolar whether it was caused or materially contributed to by the accident.
 
Liability was admitted early, and interim payments were secured to support rehabilitation. The main issue remained causation and prognosis, with complex neuropsychiatric evidence required to determine whether the condition was accident-induced or linked to an underlying predisposition.

Medical Evidence and Causation in Dispute

This required a detailed analysis of the medical literature in respect of bipolar disorder and the risks associated with developing the condition following an acquired brain injury. It was the Claimant’s case that this was not bipolar disorder; however, if it was bipolar, it would not have developed but for the accident and the TBI, and therefore the TBI materially contributed to its development.

The Defendant’s case was that the Claimant would have developed bipolar disorder within a couple of months of the index accident in any event, as they were already constitutionally predisposed to developing the condition during their lifetime, and thus no ongoing future losses were attributable to the accident.

Due to Dean Wilson’s experience and connections with medical experts within the industry, and following detailed expert analysis and reference to medical literature—including studies indicating a significantly increased risk of bipolar disorder following TBI—the parties reached a six-figure settlement at a joint settlement meeting in July 2025. The award reflected the Claimant’s inability to return to full-time employment and the need for ongoing care and support, including treatment for potential future relapses.
